You have applied for entry clearance to the United Kingdom as the proposed civil partner of a person who is present and settled in the UK.
However I am not satisifed, on the balance of probabilities, that it meets the requirements of the Immigration Rules (HC395) and in particular:
That adequate maintenance and accommodation without recourse to public funds will be available to you until the date of the civil partnership - 209.5
That there will after the civil partnership be adequate accommodation for you and your civil partner (and any dependants) without recourse to public funds in accommodation which you and your civil partner own or occupy exclusively - 209.6
That you and your civil partner will be able after the civil partnership to maintain yourselves (and any dependants) adequately without recourse to public funds - 209.7
BECAUSE
You state you met your sponsor Anne [surname] on the internet on May 12 2004 and first met in person on 22 September 2004 when you travelled to the UK to meet her. On your application form you state that you were in the UK from 20/09/04 until 07/12/04 and from 21/01/05 until 19/04/06 and maintained these dates were accurate at interview. Examination of your expired passport reveals that you were int he UK from 17/11/04 until 19/07/05 and from 25/10/05 until 19/04/06. In view of your disregard for time limit and immigration restrictions placed upon you in the past I am not satisifed that you would compy with any future immigration restrictions placed upon you in the future in the UK. At interview you were unable to credibly account for how you had spent your time and I am not satisfied that you did not take employment or provide services in the UK during that time.In support of your application you have provided a letter from your sponsor which states she is employed from 01/04/06 by [company name] as a C#Architect (sic) earning 30 000 GBP a year. However I note that at present no pay has been received and the position would likely be subject to a probationary period. In support of your application you provided a bank statement in the name of Anne [surname] which had a negative balance for the entire period/duration until 25/04/06 when a deposit of 2500GBP was made . You explained that this was a one off severance payment from two months pay from her previous employment. At interview you stated that you did not have any money or assets and had not worked in the US since doing some programming work for your father's company in the Summer of 2004. You stated that your sponsor also does not have any assets. Although you have provided a lease where you maintain you will leave with your civil partner I note there is no permission for you to reside there. You state you got engaged in December 2004.
You now state that you wish to go to the UK to enter into a civil partnership with Anne [surname]. In support of your application you have provided a provisional booking for May 22 2006 however you stated this may be delayed as there is a requirement to be in the UK three weeks prior to any ceremony. Although you claim that your sponsor will support you financially I am not satisfied that adequate maintenance and accommodation without recourse to public funds will be available to you until the date of the civil partnership or after the civil partnership.
I am also not satisfied that after the civil partnership there will be adequate accommodation for you and your civil partner (and any dependants) without recourse to public funds in accommodation which you and your civil partner own or occupy exclusively.
I therefor refuse your appliation.
